This High-Risk Services Policy (“Policy”) governs the listing, offering, acceptance, performance, and
facilitation of high-risk services on the GUMBAE platform. It forms part of the GUMBAE Terms of Use and is legally binding on all users, including clients, freelancers,
agencies, contractors, and managed-service personnel. By using the platform, you agree to comply with this Policy in full.

1 — PURPOSE AND SCOPE

1.1 Purpose

GUMBAE facilitates a wide range of services, some of which involve physical activity, regulated professions, safety risks, or third-party dependency risks.
This Policy establishes safeguards to:

  • protect users and the public
  • reduce liability exposure
  • ensure regulatory compliance
  • enforce licensing requirements
  • define platform restrictions
  • manage operational risk

1.2 High-Risk Service Categories

The following services are classified as High-Risk Services:

2 — GENERAL RULES FOR HIGH-RISK SERVICES

All High-Risk Services must comply with the following:

2.1 Legal Compliance Requirement

  • Users must comply with:
  • all applicable local laws
  • licensing regulations
  • industry standards
  • occupational safety laws
  • municipal and federal requirements

2.2 No Assumption of Safety Responsibility

GUMBAE does not:

  • supervise physical work
  • control job-site conditions
  • guarantee safety outcomes
  • assume responsibility for field execution

Responsibility rests entirely with service providers and clients.

2.3 Platform Discretion

GUMBAE reserves the right to:

  • approve or reject listings
  • suspend high-risk categories
  • restrict geographic availability
  • require verification before listing
  • remove unsafe services at any time

3 — LICENSING AND CERTIFICATION REQUIREMENTS

3.1 Mandatory Licensing

  • Where applicable law requires licensing, users must:
  • hold valid professional licenses
  • maintain active certification
  • provide proof upon request
  • ensure compliance throughout service delivery


3.2 Verification Rights

GUMBAE may require:

  • identity verification (KYC)
  • business registration documents
  • insurance certificates
  • professional licenses
  • background checks (where lawful)

Failure to comply may result in immediate suspension.

4 — INSURANCE REQUIREMENTS

4.1 Mandatory Insurance (Where Applicable)

GUMBAE may require service providers to maintain:

  • general liability insurance
  • professional indemnity insurance
  • workers’ compensation insurance
  • vehicle insurance (for transport services)

4.2 Proof of Insurance

Providers must submit valid documentation upon request.
GUMBAE may reject or suspend services without proof.

5 — CHILDCARE, ELDER CARE, AND VULNERABLE PERSON
SERVICES

5.1 Enhanced Safety Obligations

Providers must:

  • meet all legal caregiving requirements
  • pass background checks where permitted by law
  • demonstrate relevant qualifications
  • comply with safeguarding standards

5.2 Zero-Tolerance Violations

The following are strictly prohibited:

  • abuse or neglect
  • unsafe handling practices
  • unlicensed care provision
  • misrepresentation of qualifications

6 — HEALTH-RELATED SERVICES RESTRICTIONS

6.1 Licensed Professionals Only

Medical, nursing, mental health, emergency care, and similar services must be performed only by:

  • licensed medical practitioners
  • certified healthcare providers
  • legally authorized professionals

6.2 Platform Position

GUMBAE is not a healthcare provider and does not:

  • diagnose conditions
  • prescribe medication
  • provide emergency care
  • offer medical advice

7 — TRANSPORTATION AND LOGISTICS SERVICES

7.1 Independent Operator Requirement

Drivers and logistics providers must:

  • comply with transport laws
  • maintain valid driver’s licenses
  • maintain vehicle insurance
  • ensure roadworthiness of vehicles

7.2 Risk Disclaimer

GUMBAE is not responsible for:

  • Accidents
  • Delays
  • Road incidents
  • Cargo loss
  • Third-party actions

8 — SECURITY SERVICES

8.1 Licensing Requirement

Security providers must:

  • be licensed where required
  • comply with national security laws
  • avoid unlawful force or conduct
  • meet vetting requirements

8.2 Prohibited Conduct

Security providers may not:

  • act outside legal authority
  • impersonate law enforcement
  • engage in unlawful detention
  • use excessive force

9 — PLATFORM LIABILITY DISCLAIMER

To the maximum extent permitted by law:
GUMBAE is not liable for:

  • physical injury
  • property damage
  • professional negligence
  • regulatory violations by providers
  • client misuse of services
  • third-party conduct

10 — CLIENT RESPONSIBILITIES

Clients engaging High-Risk Services must:

  • verify provider qualifications
  • ensure safe working conditions
  • obtain necessary permits
  • comply with legal obligations
  • provide accurate project information
  • supervise on-site work where required

11 — SERVICE PROVIDER RESPONSIBILITIES

  • Service providers must:
  • perform work safely
  • comply with professional standards
  • maintain valid licenses
  • carry required insurance
  • report safety incidents
  • avoid illegal or negligent conduct

12 — PROHIBITED HIGH-RISK ACTIVITIES

The following are strictly prohibited:

  • unlicensed medical treatment
  • illegal construction work
  • unsafe electrical installations
  • unlicensed security operations
  • child abuse or unsafe caregiving
  • illegal transport services
  • fraudulent certification claims

13 — INDEMNIFICATION

All users agree to indemnify and hold harmless GUMBAE, including its affiliates, officers, directors,
employees, contractors, and partners, from any claims arising out of:

  • high-risk service performance
  • injury or death
  • property damage
  • licensing violations
  • regulatory breaches
  • negligence or misconduct
  • insurance failures

14 — PLATFORM RIGHT TO RESTRICT

GUMBAE may:

  • restrict categories
  • suspend providers
  • block unsafe listings
  • require enhanced verification
  • remove high-risk services without notice

15 — ENFORCEMENT AND TERMINATION

Violations of this Policy may result in:

  • account suspension
  • permanent ban
  • withholding of payments
  • legal action
  • reporting to authorities where required

16 — RELATIONSHIP TO TERMS OF USE

This Policy is incorporated into the GUMBAE Terms of Use.

In case of conflict:
This Policy governs high-risk services specifically.

FINAL ACKNOWLEDGEMENT

By offering or engaging in High-Risk Services on GUMBAE, you confirm that you:

  • understand the risks
  • accept full responsibility
  • comply with all legal obligations
  • agree to be bound by this Policy
